This Privacy Policy explains how RefBetter collects, uses and protects personal data when you visit refbetter.com, purchase a RefBetter product, access a course, book a personal session, submit game footage or otherwise communicate with us.

RefBetter processes personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (“GDPR”) and applicable Latvian data-protection legislation.

2. PERSONAL DATA WE MAY COLLECT

Depending on how you use RefBetter, we may process:

  • first and last name;

  • email address;

  • billing information;

  • country of residence;

  • information required for payment, invoicing or taxation;

  • products and services purchased;

  • account and course-access information;

  • booking dates and appointment information;

  • communications with RefBetter;

  • basketball game videos submitted for analysis;

  • information voluntarily provided during Performance Review or Development Plan sessions;

  • IP address;

  • browser and device information;

  • technical logs and website activity;

  • cookie identifiers and advertising identifiers where applicable and consented to;

  • information about interactions with RefBetter advertisements where advertising technologies are enabled.

RefBetter does not normally receive or store complete payment-card details. Payment information is processed by our payment provider.

3. WHY WE PROCESS PERSONAL DATA

A. To provide purchased products and services

We process personal data in order to:

  • process purchases;

  • provide access to the 4-Habit System;

  • create and manage customer access;

  • provide Performance Review services;

  • provide Development Plan services;

  • arrange online sessions;

  • review submitted game footage;

  • provide individual feedback;

  • communicate regarding purchased services;

  • provide customer support.

Legal basis: performance of a contract or taking steps at your request before entering into a contract.

B. Payments, accounting and legal obligations

We may process customer and transaction information for:

  • payment processing;

  • invoicing;

  • accounting;

  • tax compliance;

  • fraud prevention;

  • compliance with applicable consumer-protection and other legal obligations.

Legal basis: compliance with legal obligations and, where applicable, our legitimate interests in protecting and operating our business.

C. Website operation and security

We may process technical information where necessary to:

  • operate the RefBetter website;

  • maintain website security;

  • prevent abuse and fraud;

  • diagnose technical problems;

  • protect customer accounts and services.

Legal basis: our legitimate interests in maintaining and protecting RefBetter.

4. EMAIL AND CUSTOMER COMMUNICATION

RefBetter uses Zoho Mail for business email communication.

Personal data may therefore be processed through Zoho when you:

  • contact hello@refbetter.com;

  • ask for customer support;

  • send information relating to your booking;

  • send a WeTransfer game-video link;

  • communicate about a Performance Review or Development Plan.

We may also send transactional emails relating to:

  • purchases;

  • course access;

  • account information;

  • bookings;

  • appointment reminders;

  • service instructions;

  • important changes relating to a purchased product.

Transactional emails necessary to provide a purchased service do not depend on marketing consent.

Marketing emails will only be sent where legally permitted. Where consent is required, you may withdraw it or unsubscribe at any time.

5. GAME VIDEOS

Customers purchasing a Performance Review or Development Plan may submit basketball game footage for private performance analysis.

Submitted videos are used for the purpose of providing the service purchased by the customer.

RefBetter does not acquire ownership of submitted game footage.

Customers are responsible for ensuring that they are permitted to provide the footage to RefBetter for private analysis.

Game footage may contain images or voices of players, referees, coaches, spectators or other individuals.

RefBetter will not use submitted game footage for advertising, social media, public education, promotional materials or other unrelated purposes unless an appropriate legal basis or separate permission has been obtained.

Game footage will normally be deleted within 30 days after completion of the relevant Performance Review or final Development Plan session, unless:

  • a longer period has been agreed with the customer;

  • retention is reasonably necessary to complete the service;

  • retention is required to resolve a dispute; or

  • retention is required by law.

6. SERVICE PROVIDERS

RefBetter uses third-party service providers in order to operate the website and provide purchased services.

These may include:

Systeme.io

Website hosting, sales funnels, checkout functionality, customer management, course delivery and transactional communication.

Stripe

Secure payment processing.

Zoho Mail

Business email hosting and customer communication.

Google Calendar and Google Meet

Appointment scheduling and online video sessions.

WeTransfer

Transfer of customer game-video files.

These providers may process personal data only to the extent necessary for the relevant service.

7. ANALYTICS AND ADVERTISING

RefBetter may use analytics and advertising technologies to understand website performance, measure conversions and advertise RefBetter services.

Non-essential advertising or analytics technologies are used only where required consent has been obtained.

Meta

Where enabled, RefBetter may use:

  • Meta Pixel;

  • Meta advertising conversion measurement;

  • Meta Conversions API or similar Meta advertising technologies.

These services may be used to:

  • measure the effectiveness of Facebook and Instagram advertisements;

  • understand whether an advertisement resulted in a website visit or purchase;

  • create advertising audiences;

  • improve advertising performance.

Google

Where enabled, RefBetter may use:

  • Google Analytics;

  • Google Ads conversion tracking;

  • Google advertising and measurement technologies.

These services may be used to:

  • understand website usage;

  • measure advertising conversions;

  • evaluate campaign performance;

  • improve RefBetter advertising and website performance.

Adsterra

If RefBetter activates Adsterra, advertising or measurement technologies associated with that service may process information such as:

  • IP address;

  • device and browser information;

  • advertising identifiers;

  • advertisement interactions;

  • clicks and conversion information.

Other advertising providers

RefBetter may from time to time test other advertising platforms or technologies.

If additional tracking providers are introduced, RefBetter will update its privacy and cookie information where required and will request consent before activating non-essential tracking where required by law.

8. COOKIES

RefBetter uses cookies and similar technologies.

Necessary cookies may be used for:

  • website functionality;

  • security;

  • checkout;

  • payment processing;

  • customer login;

  • course access;

  • booking functionality.

Optional technologies may be used for:

  • analytics;

  • conversion tracking;

  • advertising;

  • audience measurement.

Optional analytics and advertising technologies will only be activated where the required consent has been obtained.

9. INTERNATIONAL DATA TRANSFERS

Some RefBetter service providers may process personal data outside Latvia or outside the European Economic Area.

Where GDPR requires safeguards for such transfers, an appropriate legal transfer mechanism will be used, which may include:

  • a European Commission adequacy decision;

  • Standard Contractual Clauses;

  • another legally recognised transfer mechanism.

10. HOW LONG WE KEEP PERSONAL DATA

RefBetter retains personal data only for as long as reasonably necessary for the purpose for which it was collected.

This may include:

Course and account information

For as long as necessary to provide purchased course access and manage the customer relationship.

Payment and accounting records

For the period required under applicable Latvian accounting and tax legislation.

Booking and service information

For as long as reasonably necessary to provide the purchased service and handle related customer-service matters.

Game footage

Normally up to 30 days following completion of the relevant Performance Review or final Development Plan session.

Consent records

For as long as reasonably necessary to demonstrate compliance with applicable privacy and cookie requirements.

When personal information is no longer necessary, it will be deleted or anonymised where appropriate.

11. YOUR GDPR RIGHTS

Subject to the conditions provided by applicable law, you may have the right to:

  • request access to your personal data;

  • request correction of inaccurate or incomplete data;

  • request deletion of personal data;

  • request restriction of processing;

  • object to certain processing;

  • receive certain personal data in a portable format;

  • withdraw consent where processing is based on consent;

  • lodge a complaint with a competent supervisory authority.

Withdrawal of consent does not affect the lawfulness of processing carried out before consent was withdrawn.

12. DATA PROTECTION SUPERVISORY AUTHORITY

You have the right to lodge a complaint with a competent data-protection authority.

13. DATA SECURITY

RefBetter takes reasonable technical and organisational measures designed to protect personal data against:

  • unauthorised access;

  • loss;

  • misuse;

  • disclosure;

  • alteration;

  • destruction.

However, no method of internet transmission or electronic storage can guarantee absolute security.

14. CHILDREN AND MINORS

RefBetter services are intended for basketball referees and persons interested in referee development.

Where a person is not legally permitted to enter into a contract independently, involvement or approval from a parent or legal guardian may be required.

RefBetter does not intentionally request unnecessary personal data from children.

15. AUTOMATED DECISION-MAKING

RefBetter does not currently make decisions producing legal or similarly significant effects solely through automated processing.

Advertising platforms may use automated systems to determine advertisement delivery or audiences according to their own privacy practices.

16. CHANGES TO THIS PRIVACY POLICY

This Privacy Policy may be updated if:

  • RefBetter services change;

  • new service providers are introduced;

  • advertising or analytics technologies change;

  • applicable legal requirements change.

The current version will be published on refbetter.com together with the latest revision date.
